ADOPTION IN PAKISTAN: SHARIAH LAW, GUARDIANSHIP & LEGAL PROCESS | OSMANI LAW KARACHI

Introduction

Adoption in Pakistan remains a complex and sensitive legal and religious issue, especially when examined through the lens of Islamic Shariah. While Islam strongly promotes the care and protection of children, the concept of adoption differs significantly from Western legal systems.

At Osmani Law, Karachi, we aim to clarify the legal position of adoption, guardianship, and child welfare under Pakistani law and Islamic principles.

Concept of Adoption in Islam (Kifalah)

Islam does not prohibit caring for children; rather, it encourages it as an act of great virtue and social responsibility. However, Islamic law replaces the concept of adoption with “Kifalah” (guardianship).

Key Principles:

  • Adopted children retain their biological identity
  • They do not automatically inherit from adoptive parents
  • Guardians are responsible for care, upbringing, and maintenance

Historical Examples of Adoption in Islam

Islamic history reflects multiple instances of child care and guardianship:

  • The Prophet Muhammad (PBUH) raised Zaid bin Harisah
  • Prophet Muhammad (PBUH) himself was raised by Hazrat Abu Talib
  • Prophet Musa (Moses) was raised in the household of Pharaoh
  • Maryam (Mary) was placed under the guardianship of Prophet Zakariya

These examples demonstrate care and upbringing without altering lineage.

Legal Status of Adoption in Pakistan

Pakistan does not recognize adoption as understood in Western law. Instead, the process is governed under:

Guardians and Wards Act, 1890

  • Adoption is processed as guardianship
  • Application is filed under Section 7
  • Court evaluates welfare of the child as paramount consideration

Important Points:

  • Biological parents (if known) must be made parties
  • Court supervision continues even after guardianship is granted
  • Child may need to be produced before court periodically

Rights of Adopted Children Under Islamic Law

1. Financial Rights

  • No automatic inheritance rights
  • Can receive:
    • Gifts during lifetime
    • Up to 1/3 share through a will

2. Identity Rights

  • Child must retain biological parentage (if known)
  • Islam strictly prohibits changing lineage

3. Marriage & Mahram Rules

  • Adopted child is not a Mahram
  • Marriage rules apply as per non-biological relations

NADRA Registration Rules Under Pakistani law:

  • If parentage is known → biological parents must be recorded
  • If unknown → documentation required proving unknown lineage
  • Adoptive parents may be listed as guardians

The issue remains sensitive due to social stigma and identity concerns.

Role of Society & Welfare Organizations

Organizations like Edhi Foundation play a crucial role in protecting abandoned children through initiatives like:

  • Jhoola (Cradle) Scheme
  • Shelter and rehabilitation services
  • Placement with suitable guardians

Islam emphasizes:

“Care for orphans and needy is a collective responsibility of society.”

Adoption vs Guardianship: Key Difference

Aspect Adoption (West) Islamic Law (Kifalah)
Identity Changed Preserved
Inheritance Automatic Limited (gift/will)
Lineage Severed Maintained
Legal Status Equal to biological child Guardian-child relationship

Can Foreigners or Non-Muslims Adopt in Pakistan?

  • No absolute legal bar
  • Courts prioritize:
    • Child’s welfare
    • Religious upbringing
  • Strict court supervision required
  • Child cannot be taken abroad without permission

State Responsibility in Islam

Islam places strong responsibility on the State:

  • Protection of abandoned children
  • Ensuring welfare and upbringing
  • Safeguarding fundamental rights under the Constitution of Pakistan

Conclusion

Adoption in Pakistan is not legally recognized in the Western sense but exists through guardianship laws aligned with Islamic principles.

At Osmani Legal, we guide clients through:

  • Guardianship applications
  • Court procedures
  • NADRA documentation
  • Legal compliance with Shariah principles

POLYGAMY IN ISLAM & PAKISTAN – SUPREME COURT’S VERDICT

(PLD 2017 SC 187)

We have made this video explain the religious and legal aspects of polygamy in Islam and Pakistan. While Islam permits a man to have multiple wives under conditions of justice and fairness, Pakistan’s Muslim Family Laws Ordinance, 1961 imposes legal restrictions. A husband must obtain prior approval from his first wife and the Arbitration Council before contracting another marriage.

The Supreme Court of Pakistan has upheld this requirement, stating that failure to seek permission can result in legal penalties, including fines and imprisonment. The video also discusses the rights of the first wife, consequences of unauthorized polygamy, and legal remedies available.

DISSOLUTION OF MARRIAGE

Marriage in Pakistan can be dissolved in the following ways:

  1. Talaq by Husband – The husband can divorce his wife at his will without court intervention.
  2. Mutual Consent – Both spouses can agree to end the marriage without going to court.
  3. Judicial Divorce (Khula) – The wife can seek a court decree for dissolution on valid legal grounds.
  4. Delegated Divorce (Talaq-e-Tafweez) – If the marriage contract grants the wife the right to divorce, she can exercise it.

Each method follows specific legal procedures under Muslim Family Laws Ordinance, 1961 in Pakistan.

A successful marriage requires patience, understanding, and mutual respect. Many relationships face challenges, but key principles can help retain and strengthen the bond. Communication is the foundation, both partners must express their thoughts openly while also listening to each other. Compromise and trust play a crucial role in overcoming misunderstandings. Moreover, fulfilling each other’s rights, as emphasized in Islamic teachings and legal precedents, ensures stability. The Supreme Court of Pakistan has also ruled on cases reinforcing the importance of resolving disputes amicably rather than rushing towards divorce. By following these principles, couples can maintain a happy and lasting marriage.
