PROHIBITION OF HAZARDOUS WASTE IMPORT:

According to the Pakistan Environmental Protection Act, 1997, the import of hazardous substances with toxic, explosive, flammable, or radioactive properties that pose an environmental risk is strictly prohibited.

REGULATION OF MOTOR VEHICLE EMISSIONS:

The operation of motor vehicles emitting pollutants or noise levels exceeding National Environmental Quality Standards (NEQS) is banned. The Pakistan Environmental Protection Agency (Pak-EPA) is empowered to enforce compliance, requiring pollution control devices in vehicles and ensuring the use of specified fuels and maintenance procedures.

 

ESTABLISHMENT OF ENVIRONMENTAL TRIBUNALS:

The Federal Government has established Environmental Tribunals in each province to hear cases under the Pakistan Environmental Protection Act, 1997. Additionally, senior civil judges have been designated as Environmental Magistrates to handle contraventions related to hazardous substances and vehicle pollution.

PENALTIES ENFORCED BY ENVIRONMENTAL MAGISTRATES:

Environmental Magistrates are authorized to impose various penalties, including:

  • Awarding compensation for damages under Section 17(5)
  • Endorsing convictions to relevant trade or industrial associations
  • Imposing imprisonment up to two years
  • Ordering factory closures or the confiscation of machinery, vehicles, and other related assets

DELEGATION OF POWERS TO PROVINCIAL GOVERNMENTS:

The Ministry of Environment, Local Government, and Rural Development has delegated its powers and functions, along with those of the Federal Environmental Protection Agency, to the Provincial Governments under Section 26 of the Act. These powers are further delegated to Provincial Environmental Protection Agencies, with plans to extend selected powers to local governments.

ROLE OF PAKISTAN ENVIRONMENTAL PROTECTION AGENCY (Pak-EPA):

Pak-EPA, under the Ministry of Environment, is responsible for enforcing the Pakistan Environmental Protection Act, 1997, and its related regulations. Pak-EPA also handles public complaints, conducts research, and prepares national environmental policies for the approval of the Pakistan Environmental Protection Council.

The National Environment Policy provides a comprehensive framework to address Pakistan’s environmental challenges, including water and air pollution, waste management, deforestation, biodiversity loss, and climate change.
